RoHS (Restriction of Hazardous Substances) Directive Compliance Statement The European Union has issued two directives to reduce waste arising from electrical and electronic equipment and for improved environmental performance during the life cycle of electrical and electronic products: · ♦ RoHS - 2002/95/EC: Directive on the Restriction of the use of Certain Hazardous Substances in Electrical & ♦ Electronic Equipment. ♦ WEEE - 2002/96/EC: Directive on Waste Electrical & Electronic Equipment. The RoHS Directive states that from July 1, 2006 forward, new electrical and electronic equipment shipped into the marketplace shall not contain lead, mercury, cadmium, hexavalent chromium, polybrominated biphenyls (PBB) or polybrominated diphenyl ethers (PBDE). For more than 15-months, Elite Electronics has undertaken a comprehensive review to define all requirements for materials compliance in our worldwide marketplaces. Our review identified almost 50 materials that are classified as ‘controlled.’ Because many of these materials have long been regarded by the electronics and telecommunications industries as potential health hazards (e.g., polychlorinated biphenyls (PCBs), asbestos, et cetera); Elite’s procedures for complying with the new more stringent requirements for controlled materials is in place and well established. Elite Electronics’ goal is to achieve compliance for all ‘controlled materials.’ Since our compliance program started, Elite Electronics achieved full RoHS compliance on June 30, 2006. All electronic and/or fiber optic components, subassemblies, assemblies, systems or hardware component inventory items manufactured and/or purchased by Elite Electronics after this date will be in compliance with RoHS and WEEE requirements. After June 30, 2006, Elite will require suppliers to provide RoHS - 2002/95/EC Directive ‘proof of compliance’ for all shipments. Unless otherwise stated at the time of purchase, all orders shipped by Elite Electronics after July 31, 2006, will be cadmium, mercury, lead, hexavalent chromium and polybrominated diphenyl ethers (PBDE/PBB) free as directed by the RoHS - 2002/95/EC Directive dated January 27, 2003. All of Elite Electronics’ products fabricated in Asia before June 30, 2006 meet this criterion because our strategic Asian suppliers adopted these requirements in 2005. Elite Electronics has been actively engaged with its supplier-base to define a cost-effective compliance methodology for all purchased materials that meet or exceed the European Union’s (EU) RoHS and WEEE Directives and/or similar requirements for the United States and North American markets. Our global supply-chain system now clearly identifies all bills of materials (BOMs) based on their applicable compliance requirements. In those instances, primarily military applications, where compliance was not been immediately achievable, Elite Electronics’ engineering and quality assurance team is working closely with its customers and the controlling agencies to affect mutually acceptable and cost-effective solutions. Elite Electronics has been in full compliance with the RoHS - 2002/95/EC and WEEE - 2002/96/EC Directives since June 30, 2006. Very truly yours, Stephen J. Kaplan President
